Definitions

• We, us, the gym, provider, Titans, TIT4NS, and or Titans Gym refers to TIT4NS Ltd. Registered Company Number #15074177.
• Facilities, kit, equipment, and or machines refers to any of the strength and fitness training apparatus located within the gym.
• You, your, user, the member, member, members, gym user and or gym users refers to any indiviudal or group of individuals who makes use of the facilities in the gym, for any purpose at any time.
• Membership, session, and or sessions refers to any purchase made which entitles you to use the facilities at the gym.
• Staffless system, door portals, vestibule and entry system refer to the entry and exit doors which are operated by the QR codes which represent your sessions as part of your membership. More broadly Staffless System can also refer to the system as a whole, encompassing both entrance and exit features, and may not specifcially be defined by entry in to the gym, but may also be more generally understood as any ingress or egress to or from the facility by members.

Summary

These terms and conditions define both of our rights and responsibilities regarding membership at Titans Gym. As a service provider we are responsible to grant you reasonable access to our facilities during advertised opening hours. We are also responsible to provide you service in terms of reasonably maintained equipment such that a user can be reasonably assured to be able to use the facilities as they intend without avoidable hindrance. As a service user you are expected to conduct yourself in a certain manner while you use the facilities in order to maintain adequate health and safety compliance as well as respect for other gym users.

Titans is a fully staffless gym, meaning that your access to the facility is governed by yourself via the use of QR codes which grant you access to the facility. Your use of these codes is your responsibility. The sessions you have purchased as part of your membership are visible on your orders page and are accessible via the Let Me In page of the website.

Titans is a professional gym; you agree that you are attending the facility with a good proficiency with the use of and understanding of the purpose for all of the facilities and equipment available. You agree that you are aware that you should seek independent professional advice regarding training, the use of fitness equipment, and any facilities on offer at Titans Gym if you are unaware of the proper function and use of the facilities and / or equipment.

Accessing the Gym

Login to the website, visit the Let Me In section, and show your QR code to the scanner on the front door. A valid code will unlock the doors and allow you access through the door portal.

1. Principal Terms

1.1 This agreement becomes a contract between you and us the moment that your payment for membership is complete. Your membership begins at that moment and ends when your last available session expires.

1.2 All memberships are not transferable.

1.3 Titans Gym opens at 05:00 and closes at 23:00 every day, all year. We reserve the right to close the gym without prior notice under exceptional circumstances. Please check the website or our social media profiles if you find that the gym is closed when you expect it to be open. We cannot be held responsible for events which could cause the gym to remain closed that are beyond our control. We will use all reasonable measures to ensure that the gym is open as advertised.

1.4 Titans Gym provides a member only service. All visitors to the gym must have a valid membership.

1.5 Gym members must be at least 16 years old. No visitor to the gym should be younger than 16 years old.

1.6 We will endeavor at all times to ensure that all equipment in the facility is maintained to a high standard and is available for use. We will, when required for safety reasons, make equipment inaccessible should it become faulty through use. In such cases we will repair equipment in a reasonable time. If equipment is beyond reasonable repair we may choose to remove that piece from operation permanently.

1.7 You agree that you are proficient with the use of all of the equipment offered for use at the gym. You agree to indemnify Titans Gym for all accidents or injury that result from misuse of the equipment available at the facility. If you are unsure how to use any of the equipment offered at the gym you agree that you should seek professional advice from a qualified personal trainer.

1.8 This agreement is governed by English law.

2. Your Conduct

2.1 You should keep the equipment you use and the area around the equipment tidy and free from weights plates, your own litter, drinks or snacks. Please be courteous and remove the weights plates that you have used from machines and place them back on the storage pins when you are finished with your use of the machine. Continual misuse of weights plates may result in your membership being cancelled.

2.2 You should be respectful of other gym users. If you are found to be unreasonably aggressive or hostile to other members while in the facility your membership may be cancelled.

2.3 You should access the gym alone and not attempt to bring multiple people in to the facility at the same time. The staffless system is designed to allow for entry of a single person. Abuse of the staffless system such that more than one person enters at the same time will result in your membership being cancelled.

2.4 The staffless system employs many safety features. Some of the safety features, including the emergency escape system, allow for the doors to be opened without the need for access codes. Misuse of these systems, or bypassing them in any way, will result in your membership being immediately cancelled.

2.5 Accessing the facility via any means other than the staffless system door portal is prohibited. This includes but is not limited to the use of the fire exit doors. Misusing emergency exits will result in your membership being immediately cancelled.

2.6 You should take your belongings with you and not leave your own kit or equipment in the gym.

2.7 We take no responsibility for any of your personal belongings.

3. Your Membership

3.1 Your membership is purchased on the website and is accessible entirely via the website.

3.2 Making a purchase of membership will grant you a number of sessions. Each session will grant you one visit to the gym for an arbitrary and undefined duration per visit to the facilities. Your membership is defined at the point of purchase as a combination of these two factors:
3.2.1 The number of sessions which you can use to access the facilities
3.2.2 The duration of time in which these sessions will be able to be redeemed

3.3 Sessions that are unused but have expired are not redeemable in subsequent or any future memberships, they do not carry forward or roll over, and are not transferable. Sessions which have expired are no longer valid and cannot be used.

3.4 Unused sessions are not refundable even if they are still valid, are unused, and have not expired.

4. Termination

4.1 The facility is monitored by CCTV at all times. Our information officer is contactable here: info@titansgym.uk. We use data collected and stored in our CCTV system to assess the behavior of members using the facility. Data is stored for 7 days.

4.2 If we witness or suspect that your conduct while at the gym is in breech of these terms then we may contact you to discuss it. It is not our intention to cancel memberships without very good reason, however, as defined in these terms, if we do see conduct that warrants your membership being cancelled then we reserve the right to cancel your membership, potentially without notice.

4.3 We will always make strong efforts to reasonably contact you prior to cancelling any membership.

4.4 We do not have extended binding contracts. This contract begins with your purchase of a membership and ends when the last session granted as part of that membership expires. You have the right to cancel and withdraw from this contract at any time.

4.5 Should you choose to cancel your agreement with this contract we will terminate your membership upon request and any / all remaining sessions will become invalid.

5. Personal Training

5.1 Purchase of a Personal Trainer membership is an agreement that you have:

5.1.1 a suitable professional qualification in personal training

5.1.2 suitable professional insurance to operate as a personal trainer

5.2 As a personal trainer you agree to furnish us with necessary documentation, upon request, so that we mas ascertain whether or not you are suitable qualified and insured to do business at the gym.

Note: it is prudent to contact us prior to purchasing a personal trainer membership so that we can process your documentation. No refunds are given for incorrectly purchased memberships.

5.3 As a personal trainer you agree to abide by all other rules, including conduct, and to encourage your client to also abide by all rules set out herein.

5.4 As a personal trainer you may only train one client at a time. We do not offer our facility out to rent, we do not offer our facility to be used for group training sessions. If you are found to be training more than one client at a time at the gym then your membership may be cancelled.

5.5 As a personal trainer you indemnify Titans Gym from all responsibility pertaining to your client while they are under your supervision.

5.5 You may cancel your trainer membership at any time upon notice given, any remaining sessions will become void.

Purchase of a membership of any type is an agreement to these terms. Your membership may be subject to further restrictions based on type, in particular but not limited to Personal Trainer memberships. Please see your specific agreement in those cases.
